1. Introduction

Welcome to our swimming academy. By registering and using our services, you agree to these Terms & Conditions. Please read them carefully before creating an account.

2. Registration & Account

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account
• You must be at least 18 years old or have parental consent
• One account per person - duplicate accounts may be deleted

3. Booking & Payments

• All bookings must be made through our official website or authorized channels
• Payment is required at the time of booking unless otherwise stated
• We accept Cash, M-Pesa, and Card payments
• Prices are subject to change with prior notice

4. Cancellation & Refund Policy

• Cancellations must be made at least 24 hours before the scheduled class
• Late cancellations or no-shows may result in forfeiture of payment
• Refunds are processed within 7-14 business days
• Medical emergencies are handled case by case with proper documentation

5. Health & Safety

• All participants must disclose any medical conditions or swimming limitations
• We reserve the right to refuse service for health and safety reasons
• Children under 5 must be accompanied by a parent/guardian
• Proper swimwear is mandatory

6. Conduct

• Respect instructors, staff, and other participants
• No running, pushing, or rough play in pool areas
• Follow all safety instructions and pool rules
• We reserve the right to remove disruptive participants

7. Liability

• Swimming involves inherent risks that you acknowledge by participating
• We are not liable for personal injury, loss, or damage to personal property
• Participants swim at their own risk

8. Privacy

• Your personal information is protected and never shared with third parties
• We may use your contact information to send booking confirmations and updates
• You can request account deletion at any time

9. Changes to Terms

We may update these terms from time to time. Continued use of our services constitutes acceptance of the updated terms.

Service Agreement & Contract

1. Parties

This agreement is between the swimming academy ("Provider") and the registered member ("Participant").

2. Services Provided

• Professional swimming instruction by certified coaches
• Access to swimming pools during scheduled class times
• Use of basic swimming equipment (kickboards, noodles, etc.)
• Progress tracking and skill assessments
• Certificate upon course completion

3. Participant Commitments

• Attend classes regularly and arrive 10 minutes early
• Complete the assigned number of classes in the course
• Follow safety rules and instructor guidance at all times
• Maintain proper hygiene (shower before entering pool)
• Inform instructors of any health changes or concerns

4. Provider Commitments

• Provide qualified, certified swimming instructors
• Maintain clean, safe swimming facilities
• Ensure proper lifeguard supervision
• Provide appropriate equipment for training
• Issue certificates upon successful completion

5. Class Schedule & Attendance

• Classes are held according to the published schedule
• Missed classes may be rescheduled based on availability
• Excessive absences may result in course extension fees
• Classes may be cancelled due to weather or maintenance with prior notice

6. Fees & Payment Terms

• Full payment is required before starting classes
• Fees cover instruction, facility use, and basic equipment
• Additional fees apply for: private lessons, equipment rental, extended courses
• No refunds after the first class has been attended

7. Medical & Emergency

• Participants must disclose any medical conditions (heart conditions, asthma, injuries)
• In case of emergency, we will contact the emergency number provided
• We may administer basic first aid when necessary
• Participants with contagious conditions must not attend until cleared

8. Photography & Media

• We may take photos/videos of classes for training and promotional purposes
• Parents will be notified if photos of minors are used publicly
• You may opt-out of photography by informing staff

9. Termination

• Either party may terminate this agreement with written notice
• We may terminate for: non-payment, safety violations, disruptive behavior
• Refunds upon termination are subject to our refund policy

10. Agreement

By checking "I Agree" and creating an account, you acknowledge that you have read, understood, and agree to be bound by these terms and this contract.

This is a legally binding agreement. Please keep a copy for your records.
